Terms and Conditions
1. General Provisions
The following terms and conditions apply to purchases in the online store www.mototechnik.cz (hereinafter referred to as the seller) and define the rights and obligations of the seller and the buyer.
2. Subject of the Agreement
The subject of the agreement are the items explicitly stated in the order (hereinafter referred to as the goods). All goods are clearly identified by their code, name, execution variant (e.g., left, right), and price.
3. Ordering Goods
The goods offered on www.mototechnik.cz can be ordered through the order form in the online store, by phone at 724/205024, or in person at the address Býšť 136, Býšť, 53322.
All orders placed through the above methods are considered BINDING.
The buyer may cancel or modify the order no later than 24 hours after placing the order by phone at: 724/205024.
By placing the order, the buyer confirms that they have read the terms and conditions and the complaint procedure, which are available on www.mototechnik.cz, and that they agree with them.
The seller reserves the right to cancel the order or part of it in cases where the ordered goods are no longer available or for other reasons. In such cases, the buyer will be promptly contacted by the seller, and further steps will be agreed. If the buyer has already paid part or the full purchase price, the amount will be refunded to their account or sent to their address without delay.
Legal relationships arising from the conclusion of the purchase contract are governed by the relevant provisions of the Civil Code, particularly the provisions on the conclusion of contracts using distance communication means. The buyer has the right under § 53 par. 6 of the Civil Code to withdraw from the contract within 14 days of receiving the goods delivered by postal workers (this does not apply if the buyer collects the ordered goods in person). If the buyer decides to withdraw within this period, the following conditions must be met: - the goods must be delivered at the buyer's expense or sent to the seller’s address (not by cash on delivery) - the goods must not be damaged and must not show signs of improper use or wear - the goods must be in the original or appropriate packaging. For replicas of spare parts, there may be slight deviations from the original. If this deviation does not prevent the proper function of the part or if the defect is of a minor cosmetic nature, complaints will not be accepted.
After receiving the returned goods, the seller will refund the corresponding amount within 14 days using the previously agreed method. The refunded amount will equal the difference between the purchase price of the goods and the delivery costs.
If any of the above conditions are not met, the seller will not accept the withdrawal from the purchase contract, and the goods will be returned at the buyer's expense.
4. Price and Payment
Unless otherwise stated in the product description, the price offer for the goods is valid for the duration of the publication on www.mototechnik.cz.
The price of the goods is subject to additional delivery costs - see point 6.
Customers from Slovakia will make their order in CZK, and the post office will convert the price to EUR based on the current exchange rate at the time of receipt. Other methods of payment from Slovakia are not possible.
5. Delivery Time
The standard delivery time is a maximum of 8 working days unless otherwise stated in the detailed description of the goods offered on www.mototechnik.cz or announced on the online store's website. The delivery time must be added to the delivery times of the carrier (Czech Post). The delivery time may be extended due to circumstances beyond the seller's control (e.g., temporary out of stock). In such cases, the buyer will always be informed immediately about the extended delivery time.
6. Delivery Methods and Payments, Delivery Costs
The goods are sent via Czech Post – the postage is uniformly set at 150,- CZK. For reduced postage of 110,- CZK, we send ONLY for orders of: production labels, 1 piece of wire/cable, 1-5 pieces of individual engine seals (does not apply to engine seal kits), exhaust manifold seals. No packaging fee is charged. For Slovakia, the postage is uniformly set at 309 CZK.
The buyer is obligated to inspect the goods upon receipt. If mechanical damage to the package is detected, the buyer must immediately check the condition of the goods, and in case of damage, a damage report must be written in the presence of the carrier. The responsibility for any damage during transport is borne by the carrier. The buyer must promptly inform the seller of the extent of the damage to the goods.
The delivery time of Czech Post is approximately 1 - 3 working days.
7. Final Provisions
These terms and conditions apply in the version published on www.mototechnik.cz on the day the order is placed, unless otherwise agreed in writing by the parties.
